Background Information:
The fragility of the situation in Somalia over the past 20 years has resulted in a collapse of the
health sector regulations. There is no legal framework that oversees and guides the whole health
sector, both private as well as public, in order to protect the public interest. The absence of a
regulatory legal framework that guides the implementation and monitoring of health related
laws to define the role of health in relation of other actors, regulations and standards has led to a
number of parallel and fragmented systems and structures for health provision which do not
ensure accountability and transparency in the health system.
There is a recognised need by the government to define its role in health in relation to other
actors which can be accomplished through the development of regulatory legal framework and
related public health lawslacts, regulations, standards especially in areas of international health
regulations, framework convention on tobacco control, regulations concerning environmental,
occupational health, safety of food and drinking water, infectious disease control, regulation of
medical products, vaccines and technology and other areas indicated by the health authorities
should be included.
In this context WHO Somalia is recruiting a consultant to conduct an assessment of the right to
health and existing or past health laws in the country in preparation of the legal framework and
the public health lawlacts.
Objectives of Consultancy:
The purpose of the consultancy is to review existing and past public health law and regulations,
and conduct a right to health and health care assessment at the country level using the WHO
assessment tool kit.
Brief description of tasks, duration and expected results:
Under the supervision of WHO Somalia Medical Officer, PHC and the overall guidance of the
WR and in collaboration WHO Regional Office, the Health Authorities, relevant government
institutes, UN agencies and other stakeholders, the consultant will work with WHO focal point to
review the existing laws and regulations applying the WHOIEMRO assessment tools. This will
be with technical support and guidance Medical Officer, Health, Human Rights and Diplomacy
in WHOIEMRO.
The duration of the consultancy is expected to be two months; it will cover the following tasks:
Desk review and data collection and analysis as per WHOIEMRO tools and guide.
Travel to the 3 zones in Somalia for consultative meetings with health authorities, other
lines ministries, government institutes, and relevant stakeholders.
Prepare two country reports applying the country report layout and format
Expected deliverables:
Two country review and analysis reports one on Right to health and heath care, and the other on
public health laws and regulations.
REQUIRED QUALIFICATIONS
Education:
Essential
Advanced University Degree in Public Health
At least eight years combined experience at national and international levels working in
countries of transition and post-conflict to provide sound methodological, technical
advisory and guidance in developing legal framework and public lawlact.
Broad knowledge of relevant public health issues and respective legislations, and other
relevant areas in transitional and fragile environments.
Experience in conducting desk reviews and preparing country analysis reports on public
health and health system issues preferably health policies.
Literacy in Somali language
Skills:
Excellent writing and presentation skills, and inclusive facilitation and coordination skills
Excellent communication and negotiation skills, capable of developing and maintaining
effective working relations with high level government bodies and different
organizations.
Proven skills in report writing.
Other Desirable Skills:
In-depth knowledge of administrative and governance structures in Somalia
Excellent command of written and spoken English required.
